Marriages of Campbell, Boone and Kenton Counties, Kentucky, 1795-1850 - Lengthy Text! (Because I found it interesting and valuable!)

Campbell, Boone and Kenton counties are the northernmost counties of Kentucky. All are situated along the Ohio river across from the Cincinnati, Ohio, metropolitan area. The oldest is Campbell County, formed in 1794 not long after Kentucky was granted statehood in 1792. Boone Co. was formed from the western portion of Campbell Co. in 1799. Until 1840 when Kenton Co. was formed from Campbell Co. in between the two, the older pair comprised the northernmost territory of the young commonwealth for four decades. Those decades also happened to witness the tremendous westward migration in the United States, much of which passed by the shores of these counties along the Ohio river, a major route to the new west. The location of the counties along this migration trail thus gives them additional importance as genealogical sources, since many of their settlers--and particularly their offspring--moved further west during this period to Indiana, Illinois, Missouri and beyond. Another feature of the marriage records is that some contain invaluable information on family relationships not generally available elsewhere except in probate and some court records (guardianships, orphans, suits, etc.). These statements of relationship in the marriages records occur in the "consents" (below). Early marriages took place in the framework of "An Act for Regulating the Solemnization of Marriages," passed on February 3, 1798, by the General Assembly. Two provisions of that Act are of particular interest to genealogists. The first is that marriage licenses were to be issued by the clerk of court in the county where the female resided. That requirement was almost always observed, but there are a few exceptions. The second is that consent was required by the father or guardian if either party was under 21. Thus, a strong presumptive case exists that a person listed in the records as giving consent -- of the same name as the bride -- is her father. Unless that relationship is stated, however, the case is only presumptive, not proven: the person could be a paternal uncle who served as guardian, for example. Happily, many such relationships are stated; unfortunately, many others are not. Where the person giving consent is not identified, the phrase in brackets "[relationship not stated, or RNS]" follows the citation. In practice, the records show that parental consent was often recorded even when one of the parties--usually the bride--was over 21. With two witnesses, consent could be given in writing. The last entry in the listings in this volume is of those witnesses (abbreviated "w by") to the consent. The procedure was for the groom to obtain a license from the county court and post bond. (Two bondsmen were required. Invariably, the groom was one and thus is not listed separately as such in this book.) A Minister then performed the ceremony and was supposed to return a certificate to the court clerk affirming that the marriage actually took place. Thus, a marriage could produce four pieces of paper: a bond, a license, a minister's "return" and a consent (above). The clerk was supposed to list the licenses and returns in a marriage book. Not all the licenses made it into the marriage books; transcribing returns was even more spotty, in part because the Ministers often did not make their returns until much later, if ever. In the absence of a return specifying the actual marriage date, the bond date ("BD") or license date ("LD") is listed as a substitute. Neither is the actual date of marriage, which usually occurred a day or two later. In rare cases, a license would be returned "without endorsement," presumably meaning the marriage never took place. Theoretically, these three (or four) pieces of paper relating to each marriage should be available. In practice, though, many were lost or never submitted (especially the "returns"). The information in this volume is based on both the marriage books and on those extant scraps of paper containing the individual documents. A caution on spellings: many persons in those years were illiterate and did not know how to spell their names. Thus, the court clerk in many instances wrote down the name as he saw fit, often phonetically. Perversely, the clerk sometimes changed the spelling when he transcribed the names from the papers to the marriage books. The last names are transcribed here exactly as they were spelled in the original records. Vowels were often used interchangeably, e.g., Kannady/ Kennaday/ Kennady/ Kennedy. A greater problem in searching occurs when a different beginning consonant of a surname is used, e.g., Clore/Glore, or Crooger/Kruger. Thus, every conceivable spelling should be searched for using your browser's "Find" button. For Boone county only, the page numbers from the corresponding original documents are found at the end of each entry--for example, Marriage Books "A," "B," "C," etc., the originals of which are kept in a vault in the clerk's office.
